Terms & Conditions

These terms and conditions apply to the Days Since application for Apple platforms (iOS, macOS, watchOS), created by Pablo Butron (hereby referred to as "Service Provider") as a Freemium service.

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application.

1. Subscriptions and Premium Features

Days Since is available as a Freemium app. Basic functionality is provided free of charge, while advanced features (such as iCloud Sync via SwiftData, cross-device support, and unlimited events) require a Premium purchase.

• Billing: Premium features can be unlocked via auto-renewing subscriptions (Monthly, Yearly) or a One-Time Lifetime Purchase. Payment will be charged to your Apple ID account at the confirmation of purchase.
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Management & Cancellation: You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase. The Service Provider cannot cancel subscriptions on your behalf.

2. Data and iCloud Sync

Premium users utilize Apple's CloudKit infrastructure to sync data across devices. The Service Provider is not responsible for data loss, sync failures, or iCloud outages caused by Apple's servers or the user's lack of internet connectivity.

3. Intellectual Property & Usage Restrictions

Unauthorized copying, modification of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, and other intellectual property rights related to the Application remain the property of the Service Provider.

4. Updates and Availability

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. They reserve the right to modify the Application, drop support for older OS versions (such as iOS versions below iOS 18), or adjust pricing at any time. Any active subscriptions will be honored for their duration, and price changes will be communicated via Apple's standard App Store procedures.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE SERVICE PROVIDER BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, BUT NOT LIMITED TO, EMOTIONAL DISTRESS FROM MISSED DATES, DATA LOSS, OR DEVICE FAILURE) ARISING OUT OF OR RELATED TO YOUR USE OR INABILITY TO USE THE APPLICATION. YOUR EXCLUSIVE REMEDY FOR DISSATISFACTION WITH THE APP IS TO STOP USING THE APP.

6. Termination

The Service Provider may terminate or suspend access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Changes to These Terms and Conditions

The Service Provider may periodically update their Terms and Conditions. You are advised to review this page regularly for any changes.

These terms and conditions are effective as of 2025-01-01.
